Conjugal Partners
If you are not married but wish to immigrate with your partner, there are only two categories that might apply: common-law (which will be discussed in future) or conjugal partner.
What is a conjugal partner? The regulations aren't helpful, as they define "conjugal partner" to mean "in relation to a sponsor, a foreign national residing outside Canada who is in a conjugal relationship with the sponsor and has been in that relationship for a period of at least one year."
Essentially, a conjugal relationship is "marriage-like", meaning that there must be a serious commitment to spend your life together in a monogamous relationship.
Citizenship and Immigration Canada look for the following elements to determine if a conjugal relationship exists:
- mutual commitment to a shared life;
- exclusive – cannot be in more than one conjugal relationship at a time;
- intimate – commitment to sexual exclusivity;
- interdependent – physically, emotionally, financially, socially;
- permanent – long-term, genuine and continuing relationship;
- present themselves as a couple;
regarded by others as a couple; - caring for children (if there are children).

The fiance category was eliminated when the new Immigration and Refugee Protection Act was enacted on June 28, 2002. You and your fiance would have to apply as common law or conjugal partners in order to immigrate together.

In response to Vilma, if your fiance can get a temporary resident visa, you can marry here and apply here. It takes about 6 months, and he can stay past his visa if processing is not complete by the time his visa expires.
In response to the Canadian married to the American, you have 2 choices:
1) Get an HRSDC confirmed job offer (tough to get unless he has specialized skill).
2) Sponsor him for permanent residence and submit an application for an open work permit at the same time (this still takes about 3 months at the earliest).

In response to Jenny -- there is nothing preventing you from visiting, however, if a Visa officer is of the opinion that you won't return to your home country at the end of your visit, you will be denied entry. It all depends on the facts of your case.

Hi I am currently on a visitor visa my girlfriend for 4 and a half years became a permanent resident of canada last june 2005 when her family got approved on their application as immigrants but only arrived april 23, 2006 after our graduation from college. We are planning to get married but we are having a hard time finding a person who does same sex marriage. is it possible for us to apply as conjugal partners? we have check the website but the sponsorship only applies for spouses and common-law partner. I´m desperately looking for some advice. I am a Canadian Permanent resident who is planning to get married with my fiance in Indonesia next year in June after a 1.5 years of long distance relationship.
I am hoping she could come with me to Canada after the wedding and wouldn´t have to be separated again while waiting for the spousal sponsorship application. It is hard enough to be in a long distance relationship for this long already.
Is there anyway we could start applying from now? So hopefully it could be finished by the time we get married or at least not too long after that. Can we be considered as common law or conjugal partner if we don´t live together? I have all the phone bills as proof of our constant communication in the past years, and stamps on my passport of my visits to Indonesia. And I will change beneficiaries of all my insurances as well if that could help.
At first I thought we could just apply for a visitor visa for my wife after the wedding just so she could come to Canada then apply for the spousal sponsorship PR from within, but I just found out that they won´t issue a visa for anyone who plan to come to Canada to live here.
Any suggestions would be greatly appreciated. I personally think there is nothing worst than not being able to be with your spouse after your wedding, and that is all I wanted to avoid.

Hard to say if you will qualify as conjugal partners -- you have to start with the factors I mentioned above. In my experience, it is a little tough to qualify as conjugal but it can be done.
Hey , im glad i could find this blog as i need help. i have been in a long distance relationship with my wifey who is a citizen living in canada for a little more than a year now. we are very serious about each other and would like to qualify as conjugal partners because we hate having to be satisfied with short trips to see each other. what kind of evidence would we need exactly to show that we have been serious and intend to remain serious and get married? (airplane ticket stubs, telephone bills maybe)?
You'll need all those and more -- "intermingling of affairs" is good, such as joint bank accounts, joint property, etc. As I said, conjugal is a tough category, so be prepared.

I am currently living in China, living together with my fiancee.
In February, I am returning to Canada to visit, and next year I will return to finish my degree.
It makes more sense, financially, for me to just stay in Canada and work full-time from Feb. to August, but I am concerned about how my fiancee can come to Canada for the year and a half I have left on my degree (two years if courses don't schedule smoothly).
We are in a serious, committed relationship, but can only prove that we have been living together since July.
Before July, she was finishing her degree, and lived on campus, so even though she stayed in my apartment every night, her official address is different than mine.
We have been in a serious, committed relationship for over a year, but it looks like proving conjugal status will be too difficult for us.
Also, as she is a recent graduate, she does not have enough work experience to pass the point system for a skilled worker visa.
We know alot of Chinese people who have applied and failed for tourist visas (TRVs) to Canada; most of them claim that they lacked adequate funds, despite having over 30,000 RMB (roughly $4,000 CDN) in the bank.
I am unsure of how TRV applications are assessed, other than the vague information listed on the consulate's site, and even more vague responses given to me by the consulate in Shanghai.
My main concern is that we will not be able to prove that she will return to China when her visa expires, especially if I will be staying in Canada.
Do you have any suggestions?

TRV's for Chinese citizens are tough to get unless the individual has a solid career in China, some assets (such as property) and family.
You don't have to live together to show conjugal status, but you do have to prove your commitment to a life together. Joint bank accounts, joint property, reciprocal insurance policies, travels together, extended time together -- without these sorts of things you won't likely be successful. On top of that, you need a good reason why you are not married -- I'm not sure that simply being students is good enough, but perhaps her parents want you to complete your schooling or something like that.
In any case, it will be an uphill battle I'm afraid. CIC looks at conjugal applications very carefully.

If she gets this, can her visa be extended either by the company she is working for, or wouild I be able to sponsor her. I am currently a student but by the time the 1 year expires I will be finished school and gainfully employed.

We have our relationship for about 6 years now but it is not known to many people esp. our family and relatives, only to some of our close friends since we are not known to be gay.
I already sent the forms to my gf and hopefully we could accomplish everything at the end of the first quarter.
Do you see any chance in our application to be approved?

I am a married, though estranged UK citizen and have been in a committed relationship with my canadian citizen girlfriend since may of 2006.
We do not have joint bank accounts but are soon to get a joint lease on an apartment, I also receive billing from my cell provider to her place where I currently reside on a visitor's visa.
I am a qualified multimedia creator, graphic designer, web designer and also have experience with carpentry...but none of these occupations seem sufficient as skilled worker qualifications as my "full-time" experience in any of them is limited by my freelancing in all of those fields over the past 10 years.
My question is this, would a conjugal partner approach have more likelihood of success for us or would I be better to approach it as a skilled worker(and if so, how to convince cic of my skillset where documentation is lacking? references? CV?)

We have been living together since we started school in September 2006. Since he's American he pays international fees which puts a financial strain on our relationship. Mr Panusa, I am an american citizen, currently a student ,and in love and engaged to an ontario born quebec resident.I am a student now, and he will be studying in the fall also. I intend to hire a lawyer for representation but I wonder, can my fiance sponsor me to to get Quebec residency even though he has a limited amount of funds because he will be living off student loans and part-time employment? I will also be in the same economic situation. Is this a problem? Also, as far as proof of long-distance contact, at what point in the application process will we need to present these documents? I don't think we have alot at this time except for letters, and statements from friends or relatives- not alot of recorded phone stuff, maybe bank statements showing purchase of phone cards for cell-phone is all. Alot of this proof will be accumulated after the marriage and probably after the first steps of the application process. We have managed to stay together for most of our year and a half relationship with just a 1-3 months apart every 4-5 months. There is no legal "separation" status in Chile so until my divorce goes through so, at least according to Chilean law, I am still married to my ex-husband.
My question is if my partner and I will still qualify as common law partners given the fact that I am still going through divorce proceedings from a previous marriage. I love my boyfriend and I don`t want to go study for two years in Canada without him.

We are filling out a restoration of status form my boyfriend who was here on a work permit and tried to have it extended, however the labour opinion was negative (more than once) so it was not extended. Now he wants to change to visitors and restore status(his visa ran out Dec 15/06).
What is the best course of action. We want to get married in June or July but wonder if it is advisable to use this as the reason to extend? We have paid for the official receipt ($200.00) and have had photos taken, but just need guidance regarding reason for restoration.
As well, if you help with this, is there an appeal process if his temp visa is denied, or any other course of action we can take at that point, if that were to happen?

Need your advice please. My brother in the Philippines has been legally separated for 4 years and wants to apply as skilled worker for Canada. His two children ( ages 17 and 18) live with him. Is it necessary for him to file a ANNULLMENT ( no divorce in the Philippines) or a letter from the ex spouse stating that she is allowing them to migrate to Canada sufficient? Would there be problems if only a letter is presented to immigration?

My current fiance lives in Canada and I live in America. My fiance wants to sponsor me so we can be together before the wedding, but he is legally divorcing someone else he has sponsored for two years. They have been seperated for a little over a year and that's how long we have both been dating each other. I have stayed in Canada for most of the time, but no more than six months due to Canadian visiting laws.
We want to be together before our wedding, but it seems we are not able to right now due to the divorce. He is finalizing the divorce after he visits me in America with his vacation time so he can be in Canada through the divorce and figure out how he can sponsor me.
So my general questions would be:
Will this previous marriage affect us in any way at all?
Is there any way I could live up there when he's divorced, but we're still waiting till 3 years have gone by since she became a resident?

My Names Justin and my girlfriend lives in america (colorado) and we love each other more than anything and know that we want to be together for the rest of our days. But my question for you is how can i prove that to immigration. See in september it will be a year, and we plan on applying for the conjugal partner application right away. In the past we havent had enough money to move her up here with me, but now things are turning around and by august we should both be financially set to move her up here. So basically i just want everything to go smoothly as possible it would really suck to put nearly 500 dollars into an application and have some official tell me our relationship isnt 'legit'. I was thinking of attaching some of my phone bills to it to show the length of time that we talk and that we stay in contact every single day, whether through talking or texting. Not to mention all conversations have been through cell phones which have greatly put me in debt, but doesnt really bother me.... Also I was wondering what other forms/applications we'd need to fill out to ensure she could get a job asap, i'm a university student so supporting the two of us would be difficult. Finally I live in Alberta and i once read that the albertan government is accepting a higher amount of immigrants due to the immense amount of jobs there are here. I am an Australian and have been in a serious relationship and co-habiting with an Canadian for at least one year. We wish to go allpy for a PR under on common law grounds, but we do not have a lease that dates back 1 year ago. Is it necessary to have such documentation from a year ago (merely because we waited for the current lease to expire)? We have friends that can verify our cohabitation. To put it another way, have you known of any cases where a PR application has been approved without that documentation?
Yes, there have been applications approved without a joint lease, but carefully crafted affidavits are essential, as well as any other evidence of cohabitation.

I hope I can get an answer from you as all this immigration stuff is really confusing! So here is my situation: I am a Canadian Citizen who is currently studying in England. I started my studies in September 2006 and met my boyfriend (who's English) in October 2006. We are both studying at the same university, and will both graduate in May 2008. We are planning to move to Canada next summer, as I miss my country and my boyfriend, who came with me to visit my family last summer, really liked it overthere. We want to move to Toronto, and there find a job in our field of study. We have been living together since April, but we live with his parents so we don't have any contract to prove it, though the same address appears on payslips from my job and stuff from uni. Anyways, we want to eventually get married and are planning on spending the rest of our life together, but for that we need to stay in the same country.
So my question is: what would be the best option (and the cheapest) for us? Should we get married now (in the UK i mean; would it be valid when we're back in Canada?) or should I sponsor him ? It might be useful to know that I am from Quebec and I am currently in England on a student visa that will expire in October 2008.

I had exceed my stay in this country due to being misinformed at the Immigration office. I now have 90 days to apply for restoration. I have read there are no guaranties on being accepted. I check with Immigration so I would be 100% sure on my stay. I like would like to know how good are the chances due to this mistake. Thank you.

Firstly- wow, how lucky I stumbled on this page, secondly, how wonderful to see someone altruisticly using their training for good use!
My situation: My partner of 6 months and I are moving to Vancouver in December. He will study (1 year course). Initially he will be on a study visa.
I am British but have been living in Kuala Lumpur the past 8 months performing in a show and teaching English (I have been a self employed performing artist for over 2 years and hold an MA from UK).
My partner's parents will be granted Canadian PR sometime between the end of 2008-2009 as investors of canada, and will move out to join us then.
I am fluent in french, educated to MA level, and want to pursue my acting career in Canada while building a life with my partner.
I looked at Self-employed PR (lengthy wait and costly), and also unsure if I actually need a visa as a performing artist? If a company really wants me will they apply on my behalf once I am there or will no-one hire me?! The only reason I am going to Canada and not back to London is to be with my Partner, who along with his family will be calling Canada home.
Please please help- I'm driving myself crazy searching on the net and getting mixed information!

I have married a man from Guyana, He came to Canada on a vistor visa for one year, When we doing the permant residents application, by accident I checked off that i am sponsoring him outside of the country, therefor his interview with immigration was in Guyana, He attends the interview and they take away his passport and his visa, So now he cant return back to Canada without a passport, They told him they would give it back to him by Feb. 2008. Is there anything I can as his wife, to get him back to Canada. Are they allowed to do such things.

Chrissy -- I'm not sure you've given the entire story here. The In-Canada and Out of Canada are completely separate applications, with different forms and different offices that process each of them (it is not a matter of checking a box). Also, CIC does not have the authority to seize a foreign national's passport in a different country. So I'm at a loss with regard to your question I'm afraid.

I am a registered nurse living in the US. I have been in a long distance relationship with a Canadian for almost 3 years now. I travel to Canada approximately every 3 months of the year to get to spend time with him. We have wanted to get married since the winter of 2005, but we are not formally engaged. I was very naive about this from the beginning (July 2005), and thought it was just a matter of me applying for a job, filing a paper or two with the Canadian government and moving across the border. I have been working really hard to gather all of the necessary materials to migrate to Canada in the skilled worker class. We have a shared bank account (as of December) and he has been the primary benefactor on my life insurance policy for the past two years. Is it quicker to apply as a skilled worker or have him sponsor me as a conjugal partner? As a registered nurse, I know there is a licensing body (College of Nurses of Ontario), and I was told by them that I had to be a citizen or permanent resident to write the exam. I really love and want to live with this man for the rest of my life, and there are just so many bureaucratic (and I reluctantly say necessary?) barriers keeping us apart.

We are hoping to be able to qualify as conjugal partners. Our glich is that he has just started the police academy. With that he will have no steady income until September when he will become a full time police officer. He is eligible to collect unemployment but we are curious if that will effect our ability to apply. I don't plan on moving until December but we would like to start the application process asap. I have a question about this whole process. I recently purchased online the skilled worker visa. I am currently a student with an expected graduation date of June 2008. So, my fiance is from Bradford Ontario which is outside of Toronto. So, what is the best option. The skilled worker visa could take up to 25 months. That isn't going to work. I already paid the $400 but I don't want to continue dishing out money if I'm going to have to start over anyway if I want to get up there quicker. I am really stressed out and aggravated all at the same time. If you could help me out it would be great. All of the migration sites that I have tried are all automated phone calls and you can only talk to them for so long, and then reply to your emails a couple days later. Its a real hassle and I wish this was easy but I hope you can give me a direction to go at least. Thanks Much

Hi, thanks for your website, just a couple of quick questions that i need answers to badly. I moved from canada to australia in october 2006 where I met my partner. Since then, I returned to canada to visit in october 07 as my visa was expiring shortly (working holiday visa.)My partner came to canada for a month over christmas and I returned over here on a tourist visa as of January. We were planning on returning to canada in December but are now looking to return in august. We have joint bank accounts and a joint lease on an apartment here but have not been living together for 12 full months without seperation (not that we weren't continually committed to one another, but were not able to live together in the beginning as I was working as an Au pair and required to live with the family that I worked for). As of February 14th we have been engaged and would like to have the wedding in canada in june 2009 as i am very close with my family and friends in canada. Now, since there is no longer the fiance visa applications and we have no life insurance policies which indicate one another as beneficiaries, would we still qualify for a conjugal partner visa?!? or common law partner visa?!?!?

I was able to find the link in internet about the E-LMO application process; however, I have some specific questions:
1. Can a person that is under a visitor visa in Canada apply for an E-LMO?
2. Does the person need to leave Canada and apply from outside?
3. What happened if the visitor status has expired? Can the person request a restoration of status and E-LMO simultaneously, since there are 90 days of grace?
4. If the person needs to leave Canada because the visitor status is expired, what are the chances that a new E-LMO will be rejected because the person stayed in Canada without status? The reason for staying longer than allowed is waiting for a response for a previous LMO.

We were wondering if we could apply now as conjugal partners, and when she comes here next year on a visitor visa, we get married, and then from here apply as spouse. Or would we amend the first application.
I am divorced, she will be mid next year at which time we could apply for spousal sponsorship.

Hello, I found this post on conjugal partners quite helpful. I was in the process of figuring out which application I'm supposed to fill out for residency in Canada, and I wasn't sure if I applied as a "conjugal partner".
Could you possibly clear it up for me? I just want to know if I have the right forms to be filling out or not.
It's an application to sponsor a member of the family class, family class being defined as "a sponsor’s spouse, common-law partner or conjugal partner; a dependent child of the sponsor; the sponsor’s mother or father; a person the sponsor intends to adopt; and other relatives of the sponsor as defined by regulation."
Currently, I'm living with my boyfriend of two years (we recently had an anniversary) in Alberta. I'm a U.S. citizen, he is a Canadian citizen. His parents live with us, who are also both Canadian citizens. My boyfriend and I are both only 18.
Now, I have two dilemmas. Who should be my sponsor, my boyfriend or his parents?
Second, do I have the right forms at all? Do I fall into any of the "family class" categories?
This entire process is incredibly confusing for me. I've tried multiple times to find the right forms over the past 6 months, and each time I get thrown back to this website, even when I visit a government building for information. They just give me a paper with the same information on it! It doesn't help. I need an actual person to tell me if I'm doing this right or not. I don't want to go through all the trouble only to find out I have the wrong forms.
If you can get back to me it would be incredibly appreciated. I see many other people are asking questions as well, so I figured you would be a good person to ask this sort of thing.

Hi there. My boyfriend and I have been together for a year now. I am a Canadian citizen, he is an American citizen. We wont be able to get married for several more months due to the fact that I can't get my divorce finalized until custody issues are done with (Ive been seperated for almost 2 years now from my exhusband). So since I cant marry my boyfriend, I assume the best route to go would be the conjual partner way since we dont qualify for common-law.

How difficult would it be to prove conjual? Another concern is Im unemployed. I have been a stay at home Mother to my kids living off child support and child tax benefit. Do they waive the income requirements for conjual, or only spousal?

I would appreciate any advice you can offer. I am an american citizen. I am married to a canadian citizen. We were married may 23rd 2008 and i haven't been back to the states yet. my husband is my bestfriend. we depend on eachother for a lot. We cannot be seperated. please tell me what the best coarse of action for us to take would be. First of all, thank you for running this blog.
My question concerns my partner and my decision whether to apply as a common law couple or a conjugal partnership. We have lived continuously together in a conjugal relationship for just over a year with the exception of a 3 week visit he took to see his family back in England. We have letters confirming our cohabitance from landlords/family we have lived with but no legal lease. We have had a joint bank account for almost a year (11 months).
So...do we qualify as a common law couple despite that one month separation or because of that time apart should we apply as conjugal?

Catch is, I am a married person with another woman and having two kids, I don't want to separate from my current wife. She does not mind if I sponsor my girl friend. My girlfriend does not qualify for any thing other than sponsorship. Please give me the suggestion. Thank you

Wow Dingi, that is different! In theory one may be able to sponsor a conjugal or common law spouse while married. However, in your circumstances I don't think you would be successful. You have to show a lifetime commitment to your conjugal partner, you can't do that if you have not been separated from your legal wife for years and years. Conjugal applications are tough, and I can safely predict CIC would reject this one.

I'm a Hong Kong citizen, dated my canadian bf for 1.5 year and came to canada to live with him for about a year, as a visitor in this country. We want to apply immigration under conjugal partner canada class, that is In-Canada Application For Permanent Resident Status. I have two questions: 1. Can they process my case here? I will also apply for extension of stay as a visitor. 2. As a visitor, i do not have any utility bills to prove that i live here, and no joint lease or anything because my bf owns his property. All we can do is put me under his insurance beneficiary. We do have vacation pictures, travel receipts, phone bills, emails etc. Do we qualify as conjugal partner and what is my chance here? Hi, I ahve been in a long distance relationship with an gentleman who has dual citizenship with both the United States and England. He owns property in both countries and does not want to sell any of them. He is finaincially secure. He also has a 22 year old daughter who is a graduation of the Oxford University in London, England. We have plans of getting married. We have proof that we are in a serious relationship such as many plane tickets, stacks of calling cards, pictures and phone bills but I am just wondering if this will be enough considering you stated that conjugal partners should own things together. We do not own anything together will that be a problem even though we have all of that other proof?

I’m a Canadian citizen looking for some assistance regarding getting visa or PR for my boyfriend. He’s an Iranian citizen.
We know each other for over 12years, currently I’m 27 and he’s 29. We would like to start a life together soon but unfortunately we keep hitting road blocks. I can’t go to Iran as its very unstable there, which would leave him the option of coming here.
Is there any chance or way he would be able to get visa, or some method of entry to Canada? We need my parents consent to get engaged or married and that would require him to come here first.

I've been in a long term relationship with my partner for over 3 1/2 years now. He is a 20 year old citizen of Canada, and I am an 18 year old U.S. citizen. In 2008, he flew down to California and lived with me for 8 months but had to go back. 3 months ago, I flew up here to live with him. Currently, we have a visitor visa extension processing, but I want to apply for a visa that will give me residency and the ability to work. She has now used up her grace period because of a bad employer and now I can't think of another way to have her stay. We are both in a pinch and I need some advice..if possible some help. Me and her have been together since she got here over a year ago. What options do I have? and where can I goto to complain so the employers will prevent from doing something like this?

I don't know where to look for help and I sorry to bother you but I've been in a committed relationship for 1yr come this April with the man I want to spend the rest of my life with the problem is due to the fact that we met online and he lives in India it has been via email and web cam through skype that we talk on a daily basis how do we go about getting him a visa to Canada so we can met in person. Due to religion belief that my parents want him to convert to my religion which I grew up too but in my part I do not want to base the relationship in that. Plus the restriction of the family code here that we are not allowed to get divorce. we wanted to try the conjugal sponshorship. We both believe that marriage is not the the solution for couple to be happy together and live. He helped me with finances. We both help each other like a married couple and people both our side knows it but due to we wanted to our relationship not to be base on religion or whatnot..we would like to try an apply. I know this is tough category but we wanted to try. Please give me some light about this issue. Does religion can play a vital part in helping my case. We just want to be together in harmony which we are now..
