New Rules for Skilled Workers and Canada Immigration
With the mini "constitutional crisis" over, it appears that Minister Jason Kenney's instructions to Visa officers regarding the processing of skilled workers will stand.
Note that these instructions are effective retroactive to February 27, 2008.
Unless you fall within the new criteria for federal skilled workers, your application will not be processed and your application fee refunded. You will have to find another way to immigrate to Canada.
In order to qualify within the federal skilled worker class, an applicant must have at least one of the the following (in addition to all the other requirements of the skilled worker class):
1. An offer of arranged employment in Canada, or
2. One year of employment or student experience in Canada, or
3. You must have experience in one of the following categories (NOC reference included):

If you applied before February 28, 2008, your application will be processed according to the rules in place at that time.

My sister applied as a skilled worker before February 28, 2008. However the documents were sent back because one signature was missing.
My sister put the signature and sent the doc back to the embassy - which was in March 2008.
In February 2009 she got a letter informing her that she was denied to get immigration visa because her case was considered in accordance with the new rules.
I have a question, whether it is legal to consider her case following the new rules if new rules were not comprehend before the summer 2008 when the Minister issued the explanation of the new rules?

Hi, i think you cant do legal as at very initial stage docs not complete with signature , means your application was not complete, so you have to file again as per new rules.

When I read this list of professions, I thought it was complete non-sense. It is just another way to regulate migrants. It would be interesting to measure the number of immigrants who are allowed entry into Canada based on this list and what professions they end up going into after they have settled. There is a disconnection between the government and the regulated professions.

I actually agree with you. These professions seem pretty random to me. People should be judged on their experience and character, not solely on what they do for a living. There are better ways to do this!

I applied in Aug '08 and my application got rejected this month (Apr '09). The reason was that my NOC was not listed in the 38 listed ones. I am an IT professional and had used 2171 as my NOC. I am based in the US.
I am confused as to what I should do next. Should I reapply under 0213 or wait until the list is updated or apply under PNP program?
Any help in this regard will be greatly appreciated.

I'm work permit holder (opened) since December 2007,have been working full-time more than 1 year in Canada as a General Manager, also I've 2 years work experinece as a college instructor. Do you think I'm eligible to apply for permanent resident under the new rule? My passmark is 96.
Sounds like you have a good chance, but you should check your score -- I've never seen anyone with a 96.
I have applied under the Skill worker category in August last year and got denied today (Reason: being my profile does not qualify under the new 38 Professions), is it okay if i apply under the Provincial Nominee category ( I am based in USA on a H1B visa since last 3 years). Thanks for any advice

I have been working for 3 years in an English Medium School & College. (From grade-IX to Grade-XII.) My designation is Lecturer in Physics. According to our curriculum Grade-XI & XII is considered as college level. Now will I be eligible for skilled worker category immigration in Canada as academic subject teacher-college level (under NOC 4131-College and Other Vocational Instructors).As far as I know in Canada up to grade-XII is considered as high school level. If my work experience fulfill the required demand then according to the six selection factors I will have 67 points. So please tell me what is your suggestion?

I am a current PhD student of Electrical Engineering in Michigan and I also work full time as Research Assistant in my lab for one year.I hold a F1 visa in US, my citizenship is china. I am 23 years old and single. I calculate my points which is 57. But I am not sure if I did it right. Base on my case,do you think I have a chance to get the skilled work immigration visa? I had applied for immigration as a skilled worker, I had provided a receipt of my IELTS exam at the time of submission to CHC since i was short of points in english. But the CHC rejected my application stating that i do not meet the required 67 points but when the results were announced i had cleared my IELTS and i had achieved the required points of 67, will the CHC reconsider my case or do I have to re apply again. Please advice
If you already have a negative decision it is very unlikely CIC will reconsider your application with new IELTS scores.

We have paid the processing fees and we were informed by both e-mail and post that our application will be processed but will take about 64 months. Hi, I'm about to apply with NOC 0213: Computer and Information Systems Manager. But, I had a couple issues:
1- Neither my previous or current jobs had a contract; the checklist asks for a contract. I wont be able to provide one.
2- Neither my previous or current employers would write the 'responsibilities of each position held' in the letter of reference. My previous employer simply said they do not have the job description, my current one does not know that I am gathering this information. I do however have a couple yearly reviews from my previous employer (from a few years back) and a printout of current job description.
Should I still apply while missing the 1- contract 2- a job description from employers ??
I am surprised that (as per new NOC list), a plumber is qualified to migrate to Canada, but a software engineer is not qualified.
A manager with new NOC 0213 can get GC in USA quickly if applied with EB1 and same can get Canada PR also.
A software engineer can get USA GC in EB2 or EB3 category, but a software engineer is not qualified for Canada PR.
Microsoft chief Bill Gates, praised Canada immigration policies, perhaps he is not aware of new NOC list.

I have been working in a MNC company for the past 41/2 years out of which i worked for 21/2 years in the USA. My current designation is ASE (Assistant Software Engineer). Though on paper my designation is of a Software Engineer, I had been involving in more of managerial tasks here in this company and handled many projects with people working under me.
I want to apply for a PR for Canada and was wondering whether i am eligible for the same. I saw the skilled worker occupation list mentioning about "0213: Computer and Information Systems Managers". I selected this option in the website and took the test and got 79 points.
Please let me know whether i qualify for applying the PR for Canada.

Hi, I am a full time PhD student at University of British Columbia and I am holding a Research Assistant position for more than a year but less than 2 years. I have heard that RA positions are considered as part time jobs by Canadian immigration agency for Skilled Worker applications. Although in confirmation letter issued by university I am mentioned as a "full time employee at UBC".
Please let me know if I can get the points for 1 year of full time job experience out of this position or should I wait for 2 full years.

Scenario: My points is 67-68. I have 1 year full time with around 3 years part time while studying. I have basic french speaking and listening proficiency. FUll 25 points for Education and 10 points for age.
Question 1: I gave the IELTS but i had previously ticked high in listening, speaking and all bands when i applied. Now i need to send my documents. Sad and unfortunate, i got 7.5(high) in all bands in IELTS score EXCEPT a 6.0 in speaking(moderate). This makes my english points just 14 out of 16. I know i could appear again and get all the 16 points BUT i have no time now. Do i have to provide proof of french basic language? Do i need to give a test or a letter from where i learned is sufficient? Will my speaking score make me disqualified??
Question 2: I have just 1 year full time which is 15 points. Does my 3 years part time job earn me any points??
Question 3: I specified a fund of $11,000. Do i need to have that much fund in my account until i get approved or can the balance be up or down after i print the statement??
